Eligibility Criteria for Spousal Sponsorship
To be eligible as a sponsor, you must meet the following requirements:
- Be at least 18 years of age.
- Be a Canadian citizen, permanent resident, or registered under the Indian Act.
- Reside in Canada or plan to return if living abroad as a Canadian citizen.
- Not receive social assistance, except for disability reasons.
- Demonstrate financial independence to support yourself, your spouse/partner, and any dependent children.
Sponsors must commit to financially supporting their partner, ensuring they do not rely on social assistance after arriving in Canada.
Spousal Sponsorship Requirements
Sponsors are responsible for providing financial support for the sponsored person’s basic needs and those of any dependent children. This includes:
- Housing and utilities
- Food and daily essentials
- Personal hygiene products
- Clothing
- Any uncovered medical expenses
This financial obligation, known as an undertaking, begins once permanent residency is granted and lasts for three years. Note that the undertaking cannot be canceled or withdrawn after IRCC approval.
Income Requirements
Although there are no specific income thresholds for spousal sponsorship, sponsors must demonstrate their ability to financially support their spouse or partner. Sponsorship is not allowed during bankruptcy or if the sponsor is receiving government assistance (excluding disability benefits).
